Andrea is focused on the trust, but we are looking at the whole estate, so I suggest we use something simple like this:

WHEREAS:

It is agreeable, desirable and beneficial for all parties signed below to give and receive the full and total advanced inheritance of Clyde and Bonnie Andrews to Mike, Nathanial and Matthew Prior now, and whereas;

Clyde's Will gives each Prior one third of one third of his share of their net worth and whereas;.

With the death of Clyde, his share of the total estate is held in a trust for the benefit of Bonnie. The terms of this testamentary trust can be changed through the attached TEDRA agreement. and whereas;

It was the desire of Clyde and Bonnie that if resources were available at the end of the survivors life, that about a quarter of the estate be give to Othello Scholarships, and other community causes that they had an interest in.

Bonnie desires to give her share to the Priors in life rather than through her Will and whereas:

The future value of the estate is unknown, but all agree it is currently around 5 million dollars, and that number is acceptable to use for the advance and total inheritance.

$5,000,000 minus the $1.200,000 to be given away, leaves $3,750,000 that is divided between the three children, which is divided three ways between Mike, Nathanial and Matthew Prior for $417,000 each.

(note: these numbers will change as we finalize the trust, i think farm is going to come in with low value, which we should have July 9th.)

NOW THEREFORE:

Mike, Nathanial and Matthew each agree $417,000 is a fair and equitable inheritance and accept this as their total and final inheritance and gift from Clyde and Bonnie Andrews.

Mike will receive the title to the house at 212 North Wellington for his share. = ;

Real estate has been put on the market, and when sold, the cash will be dispersed (late 2024 or 2025).

Nathanial and Matthew will each receive $417,000, of which, funds will be used to pa= y off their home mortgage with the remainder placed in a trust. <= /font>

The trust will release one quarter of the funds every five years starting in 2030. &n= bsp;
